By accessing or using our website, mobile applications, or related services (collectively, the âservicesâ), you agree to be bound by these terms and our Privacy Policy. If you do not agree, you may not use the services.
- UM is not a medical group, hospital, or pharmacy. The services are a technology and administrative platform that connects you with licensed, independent clinicians and coordinates pharmacy fulfillment. All medical decisions are made exclusively by the independent clinicians who provide your care.
- The services are not for emergencies. If you believe you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency department. Do not delay seeking in-person care because of information obtained through the services.
We may revise these terms from time to time. Updates will be posted with a new âlast updatedâ date at the top of this page. Your continued use of the services after such updates constitutes acceptance of the revised terms.
Our Privacy Policy explains how we collect, use, and share your information, and is incorporated into these terms by reference. Please review it carefully.
1. Services overview, availability, and eligibility
1.1 What Unfiltered Medicine provides Unfiltered Medicine operates a digital platform that:
- Facilitates access to licensed, independent clinicians for telehealth consultations and related clinical services;
- Coordinates with partner and third-party pharmacies for prescription dispensing and shipment;
- Provides digital tools (intake forms, secure messaging, scheduling, reminders, refills, health education content);
- and Supports administrative services, including billing, membership management, and customer support.
UM is not a medical group, hospital, or pharmacy. UM does not practice medicine, dispense medications, or provide professional healthcare services. All clinical decisions are made exclusively by the independent licensed clinicians who provide care.
1.2 No emergency or urgent care
The services are not intended for emergencies. If you believe you are experiencing a medical emergency or a mental health crisis, call 911 immediately or go to the nearest emergency room. Never delay seeking in-person care based on information obtained through the services.
1.3 Geographic Scope
Our services are available only to patients located within Texas and New Mexico, where UM and affiliated clinicians are authorized to operate. Certain products or services may not be available in every state. You must physically be in a participating state at the time of your telehealth visit.
1.4 Age and Capacity Requirements
You must be at least 18 years old to use the services(and potentially 21 or older for some offerings). By using the services, you represent and warrant that:
- You meet the applicable minimum age requirement;
- You have the legal capacity to enter into these terms;
- You are physically located in a state where UM and affiliated clinicians are authorized to deliver services;
- and All information you provide is accurate, truthful, and complete.
1.5 No Guarantee of Clinical Approval
Meeting eligibility criteria and completing intake forms does not guarantee that you will be prescribed medication or accepted into treatment. All clinical decisions, including whether treatment is appropriate, are made solely by the independent clinician.
1.6 Insurance Exclusion
UM and affiliated clinicians generally do not accept Commercial Insurance, Medicare, Medicaid, or any other government or third-party payor programs. All services are provided on a self-pay basis. You agree to be financially responsible for all charges and agree not to submit claims for reimbursement to any government health program.
2. How the Platform Works & Telehealth Consent
2.1 Technology Platform
UM provides access to an online platform that allows patients to: create an account, communicate securely with independent clinicians, receive evaluations, and arrange shipment of prescribed medications through third-party partner pharmacies. UM provides only technology and administrative support. UM does not control or interfere with the medical judgment of independent clinicians or the dispensing decisions of pharmacies.
2.2 Telehealth Informed Consent
By using the services, you acknowledge and agree that:
- telehealth involves electronic communication of your health information;
- it carries inherent risks (like technical failures); you may always choose in-person care;
- and by continuing to use the services, you give informed consent to receive care via telehealth.
2.3 Clinical Relationship
All clinical services are provided by licensed, independent clinicians. UM does not guarantee that a prescription, treatment, or refill will be provided. Decisions are made exclusively by the independent clinician.
2.4 Pharmacy Services
Prescriptions, if issued, are transmitted to third-party licensed pharmacies. You authorize UM to share your information with such pharmacies. UM does not own or control these pharmacies, and fulfillment is subject to their professional judgment and stock availability.
2.5 Consent to Communication
By using the services, you consent to receive electronic communications (email, text, in-app notifications) related to your care, prescriptions, billing, and account activity.
2.6 Data Security Acknowledgment
While UM uses security protocols, you acknowledge that no system is completely secure. You are responsible for maintaining the confidentiality of your account credentials.
3. User Responsibilities & Account Obligations
3.1 Accurate Information
You agree to provide truthful, accurate, and complete information at all times. Providing false or misleading information may result in termination of your account and could put your health at risk.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and agree not to share your account. UM is not responsible for losses arising from unauthorized access caused by your failure to safeguard your credentials.
3.3 Responsible Use of Services
You agree to use the services only for personal, non-commercial healthcare purposes, provide complete medical history, and follow all instructions and safety warnings provided by clinicians or pharmacists.
3.4 Prohibited Conduct
You may not use the services to:
- engage in unlawful, fraudulent, or abusive activity;
- seek prescriptions for purposes of misuse or resale;
- or interfere with the services.
Violation of these restrictions may result in immediate termination of services.
3.5 Cooperation with Clinicians
You agree to answer questions honestly, notify your clinician of any side effects, and arrange follow-up care or lab testing when requested.
3.6 Technology Requirements
You are responsible for ensuring you have the necessary device, internet connection, and software to access telehealth services.
3.7 Payment Responsibility
You are financially responsible for all charges incurred. If payment fails, you remain liable for outstanding balances.
4. Billing, Membership, and Refund Policy
4.1 Self-Pay Basis
UM and affiliated clinicians do not accept insurance. All services are provided on a self-pay basis.
4.2 Membership Billing
By enrolling in a membership, you authorize UM to automatically bill your chosen payment method at the frequency displayed. Membership will auto-renew until canceled.
4.3 Prepaid Plans
If you purchase a prepaid plan, all charges are billed upfront and are non-refundable once the first order is processed.
4.4 Pausing or Canceling
You may pause or cancel your membership through your patient portal. If cancellation occurs after a prescription has been processed or shipped, the charge is final and medications are non-returnable. UM does not impose cancellation fees.
4.5 Refunds and Exceptions
Once medication is dispensed or shipped by the pharmacy, it cannot be returned or refunded. Service fees (e.g., consultations) are non-refundable once rendered.
4.6 Payment Authorization
By providing a payment method, you authorize UM to automatically charge all fees and taxes and retry failed payments.
5. Prescription Services & Pharmacy Fulfillment
5.1 No Guarantee of Prescription
Use of the services does not guarantee that you will receive a prescription. All prescribing decisions are made solely by independent, licensed clinicians.
5.2 Prescription Transmission
If a prescription is appropriate, it will be electronically transmitted to a third-party licensed pharmacy.
5.3 Compounded Medications
You acknowledge that some prescriptions may be filled by compounding pharmacies and that compounded medications are not FDA-approved. Risks and benefits will be discussed by your clinician.
5.4 Medication Availability
Medication availability may vary by pharmacy, and UM does not guarantee that any particular medication will be in stock.
5.5 Pharmacy Independence
Pharmacies are independent entities responsible for dispensing medications. UM is not liable for the professional acts, errors, or omissions of any independent pharmacy.
5.6 Prescription Transfers
Prescriptions may be transferred to a different licensed pharmacy at your request, subject to laws and clinician approval.
5.7 Patient Responsibilities
You agree to take medications ** only as prescribed** and nevershare them with others.
5.8 Controlled Substances
UM generally does not facilitate prescriptions for controlled substances.
6. Risks, Side Effects, and Important Safety Information
6.1 General Safety Disclaimer
All medications carry potential risks and side effects. Information provided by UM is educational only and not a substitute for direct medical advice.
6.2 Compounded Products
Compounded medications are not reviewed or approved by the U.S. Food and Drug Administration (FDA) for safety or efficacy.
6.3 Categories of Therapies
UM and its network clinicians may prescribe therapies in categories such as weight loss, peptides (investigational), anti-aging, hormones & sexual health, brain health, and wellness & infusions. Each category carries distinct risks, side effects, and contraindications (as detailed in the original document).
6.4 Patient Duties
You must disclose your full medical history and medication list, report side effects promptly, and follow dosing instructionsexactly.
6.5 Emergency Protocol
The services are not appropriate for medical emergencies. If you experience severe side effects or a life-threatening emergency, call 911immediately.

7. Privacy, Data Use, and HIPAA Compliance
7.1 Privacy Commitment
UM is committed to protecting your protected health information (PHI) and complies with applicable privacy laws, including HIPAA.
7.2 Use and Disclosure of PHI
You authorize UM and affiliated clinicians to use and disclose your PHI as necessary to provide care, process prescriptions, and operate the platform. Your information will not be sold to third parties for marketing purposes.
7.3 Patient Rights
You have the right to access, obtain a copy of, and request corrections to your medical records.
7.4 Electronic Communications
You consent to the use of email, sms, phone, and portal messaging for administrative and care notices.
7.5 Data Security
UM uses encryption and safeguards, but you acknowledge the
inherent risks of online communication.
7.6 Third-Party Links and Services
UM is not responsible for the privacy practices or security measures of linked third parties (e.g., labs, pharmacies).

These terms incorporate by reference the Unfiltered Medicine Privacy Policy.
8. Intellectual Property & Content Ownership
8.1 Unfiltered Medicine Content
All content, graphics, and materials provided through the services (âUM contentâ) are the exclusive property of Unfiltered Medicine or its licensors and are protected by copyright and trademark laws.
8.2 Limited License
UM grants you a personal, limited, non-transferable, revocable license to use the services and UM content solely for your personal, non-commercial healthcare use.
8.3 Trademarks
All UM names, logos, and slogans are trademarks of UnfilteredMedicine.
8.4 User-Generated Content
If you submit content (e.g., testimonials), you grant UM a worldwide, royalty-free, perpetual license to use, reproduce, and display that content for lawful purposes.
8.5 Copyright Complaints (Dmca)
You may send a notice under the digital millennium copyright act (dmca) if you believe content infringes your copyright.
9. Prohibited Conduct & Acceptable Use
9.1 General Obligation
You agree to use the services responsibly, ethically, and only for lawful purposes.
9.2 Prohibited Conduct
You may not use the services to: provide false information, impersonate others, seek prescriptions for misuse, share medications, violate laws, or interfere with the platform's functionality.
9.3 Controlled Substances and Misuse
Misuse, diversion, or unlawful distribution of prescribed medications is strictly prohibited and may result in immediate termination and reporting to law enforcement.
9.4 Acceptable Use
You may use the services only to access healthcare consultations and manage your personal health needs.
9.5 Enforcement
UM reserves the right to suspend or terminate accounts engaged in prohibited conduct and cooperate with law enforcement.
10. Disclaimers of Warranties & Limitation of Liability
10.1 No Warranties
The services are offered âas isâ and âas available,â without warranties of any kind. UM expressly disclaims all warranties of merchantability and fitness for a particular purpose.
10.2 Limitation of Liability
To the maximum extent permitted by law, UM shall not be liable for any indirect, incidental, consequential, or punitive damages. In no event shall the total liability of UM exceed the greater of: (a) the amounts you paid to UM in the six (6) months prior to the claim, or (b) one hundred dollars ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Unfiltered Medicine (UM) and its affiliates from and against any and all claims, actions, demands, liabilities, damages, and expenses (including attorneysâ fees) arising out of or related to your use of the services, violation of these terms, or misuse of medication.
12. Dispute Resolution, Governing Law & Arbitration
12.1 Governing Law
These terms are governed by the laws of the State of Texas.
12.2 Mandatory Arbitration
You and Unfiltered Medicine (UM) agree that any dispute arising out of or relating to these terms or the services shall be resolved exclusively through final and binding arbitration conducted by the American arbitration association (AAA). The arbitration shall be held in Austin, Texas.
12.3 Waiver of Jury Trial and Class Actions
By agreeing to arbitration, you and Unfiltered Medicine (UM)waive the right to a jury trial or to participate in a class action or representative proceeding. Disputes will be resolved only on an individual basis.
12.4 Small Claims Exception
This section does not prevent either party from bringing an individual action in small claims court.
12.5 Time Limit To Bring Claims
Any claim or cause of action related to these terms or the services must be filed within one (1) year after the claim arises, or itis permanently barred.
12.6 Injunctive Relief
Either party may seek temporary injunctive relief from a court to protect intellectual property rights.
13. Termination of Services & Survival of Terms
13.1 Termination by UM
UM may suspend or terminate your access to the services at any time, with or without cause, and with or without prior notice.
Reasons for termination may include, but are not limited to:
- Violation of these terms or applicable law;
- Fraudulent, abusive, or harmful conduct;
- Non-payment or chargeback of fees;
- Misuse, diversion, or unauthorized distribution of medications;
- Conduct that poses a risk to patient safety, public health, or the reputation of UM.
13.2 Termination by You
You may stop using the services and close your account at any time by contacting customer support. Termination does not relieve you of any outstanding financial obligations, nor does it guarantee a refund except as expressly provided in section 4 (billing, membership, and refund policy).
13.3 Effect of Termination
Upon termination, your right to use the services immediately ceases. UM is not liable for loss of access to health data or services once your account is terminated, except as required by law.
13.4 Survival of Terms
The following sections of these terms will survive any termination or expiration of your use of the services: section 6 (risks, side effects, and important safety information), section 7 (privacy, data use, and HIPAA compliance), section 8 (intellectual property & content ownership), section 9 (prohibited conduct & acceptable use), section 10 (disclaimers of warranties & limitation of liability), section 11(indemnification), section 12 (dispute resolution, governing law &arbitration), and this section 13.
14. Modifications To Terms & Services
14.1 Changes To Terms
UM reserves the right to modify or update these terms at anytime. If material changes are made, UM will provide notice by:
- Posting the updated terms on the website or within the platform;
- Updating the âlast updatedâ date at the top of the terms;
- and Providing additional notice (such as email) where legally required.
Your continued use of the services after any modification constitutes your acceptance of the revised terms. If you do not agree to the new terms, you must stop using the services and close your account.
14.2 Changes To Services
UM may change, suspend, or discontinue any aspect of the services at any time, including features, functionality, or pricing. UM shall not be liable to you or any third party for modification, suspension, or discontinuation of the services.
14.3 Updates To Clinical Offerings
Specific therapies, medications, or formulations may be updated, substituted, or discontinued as medical practices and regulations evolve. UM does not guarantee that any particular therapy or product will remain available indefinitely.
15. Miscellaneous Provisions
15.1 Entire Agreement
These terms, together with the privacy policy and any other incorporated agreements, constitute the entire agreement between you and UM regarding the services.
15.2 Assignment
You may not assign or transfer your rights or obligations under these terms without prior written consent from UM. UM may assign or transfer its rights and obligations without restriction (e.g., in connection with a merger or acquisition).
15.3 Severability
If any provision of these terms is deemed invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
15.4 No Waiver
Failure or delay by UM to enforce any provision shall not be deemed a waiver of that provision or of the right to enforce it later.
15.5 Force Majeure
UM shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, including acts of god, pandemics, power failures, or governmental actions.
15.6 Relationship of Parties
Nothing in these terms creates any partnership, joint venture, employerâemployee, or agency relationship between you and UM.

This Privacy Policy (âPolicyâ) describes how Unfiltered Medicine, LLC (âUM,â âwe,â âour,â or âusâ) collects, uses, discloses, and protects your information when you use our websites, mobile applications, telehealth platform, patient portal, and related services (collectively, the âServicesâ).This Policy is incorporated into and made part of our Terms of Use. 1. Introduction & Scope
1.1 Applicability
This Policy applies to all personal information collected through our Services, including:
- Information you provide directly when creating an account, completing intake forms, communicating with clinicians, or purchasing services.
- Information collected automatically through your device (cookies, analytics, IP address, usage logs).
- Information received from third parties such as affiliated pharmacies, laboratories, and payment processors.
If you are a patient receiving telehealth services, certain health information we collect and process on behalf of independent clinicians may be considered Protected Health Information (âPHIâ) subject to the Health Insurance Portability and Accountability Act of 1996 (âHIPAAâ).* When HIPAA applies, PHI will be used and disclosed only as permitted under HIPAA and our agreements with clinicians, pharmacies, and business associates.
If there is any inconsistency between this Policy and HIPAA with respect to PHI, HIPAA will control.
1.2 Washington Residents â My Health My Data Act (MHMD)
If you are a resident of Washington State, certain additional rights and disclosures apply to your Consumer Health Data, as defined by the My Health My Data Act (MHMD). Please see the Washington MHMD Addendum attached to this Policy for details.
1.3 United States Only
UM operates in the United States and our Services are intended solely for U.S. residents.
We do not target or market to residents of the European Union, United Kingdom, or other foreign jurisdictions, and we do not subject ourselves to the GDPR or UK DPA.
If you are located outside the United States, you should not use the Services.
1.4 Acknowledgment
By using the Services, you:
- Confirm that you have read and understood this Policy;
- Consent to the practices described herein; and
- Agree to the collection, use, and disclosure of your information as described.
2. Notice at Collection (California)
If you are a California resident, we are required to provide you with a clear âNotice at Collectionâ explaining what categories of personal information we collect, the purposes for which we use them, whether we âsellâ or âshareâ them, and how long we retain them.
The following summarizes these requirements under the California Consumer Privacy Rights Act (CPRA).

Commercial Information: Examples include purchase history, payment card details (processed by Stripe). Used for billing, order management, customer support. Not sold/shared. Retained for 7 years (tax/financial law).
Internet or Other Network Activity: Examples include browsing data, device type, cookies, analytics logs. Used for site functionality, analytics, fraud prevention. May be shared with advertising/analytics providers (non-PHI only). Retained for 13â24 months.
Geolocation Data: Examples include approximate city/state from IP. Used for fraud prevention, regulatory compliance, availability of telehealth. Not sold/shared. Deleted after 13 months (analytics).
Sensitive Personal Information: Examples include health-related information, PHI, diagnoses, prescriptions. Used for telehealth care, pharmacy services, compliance with HIPAA. Never sold/shared for advertising. Retained as required by HIPAA/state law (7â10 years).
Inferences: Examples include segmentation into patient groups for services (e.g., weight loss program eligibility). Used to improve services, personalize experience. Not sold/shared. Retained for varying periods depending on clinical and business needs.
2.2 Important Notes
No Sale of PHI: We do not sell or share PHI or any information covered by HIPAA.
Non-PHI Data: Limited non-health browsing/device data may be âsharedâ with analytics/advertising vendors. You can opt out through our cookie banner or by enabling Global Privacy Control (GPC) signals in your browser.
Sensitive Information: Sensitive data (such as health details) is collected only as necessary to deliver healthcare services, comply with law, or with your consent. It is never used for targeted advertising.
Retention: We keep personal information only for as long as necessary for the purposes described, or as required by law. See Section 8 (Data Retention) for details.
3. Categories of Information We Collect & Sources
We collect the following categories of information when you use the Services:
3.1 Information You Provide Directly
Account & Registration Information â name, email, phone, address, password.
Health Information / PHI â medical history, medications, symptoms, lab results, questionnaires, and other data you provide during telehealth visits.
Payment Information â credit/debit card number, billing details (processed securely by Stripe or similar processors; UM does not store full card numbers).
Communications â messages, emails, phone calls, or SMS you send to us or to clinicians through the platform.
Identity Verification Documents â copies of government-issued ID or other materials if required for compliance.
3.2 Information Collected Automatically
Device & Technical Data â IP address, browser type, operating system, mobile device identifiers, app version.
Usage Information â pages visited, actions taken, referring/exit pages, session times.
Cookies & Similar Technologies â pixels, SDKs, and analytics tools used for site performance, fraud detection, and (non-PHI) advertising measurement. See Cookie Notice.
Approximate Location â derived from IP address, used for state eligibility, fraud prevention, and regulatory compliance.
3.3 Information We Receive from Third Parties
Clinicians & Pharmacies â treatment notes, prescription details, pharmacy fulfillment data.
Laboratories â diagnostic test results.
Payment Processors â transaction confirmations, fraud detection data.
Marketing / Lead Generation Partners â contact information for individuals who have opted in to receive communications.
Data Enrichment Services â limited demographic or contact updates to maintain accurate records (never used for PHI profiles).
3.4 Special Note on PHI
Health information that qualifies as PHI under HIPAA is collected, used, and disclosed in compliance with HIPAA and applicable state law.
PHI is never used for targeted advertising, profiling, or cross-context behavioral ads.
4. Purposes for Using Information
We use the information we collect for the following purposes, depending on the type of data and your relationship with Unfiltered Medicine (âUMâ):
4.1 Service Delivery & Account Management
To create and manage your account.
To verify your identity and eligibility to use our Services.
To schedule and conduct telehealth consultations.
To coordinate with affiliated clinicians, pharmacies, and laboratories.
To process orders, prescriptions, and payments.
4.2 Clinical Care & PHI-Specific Uses
To enable clinicians to evaluate your health, provide diagnoses, prescribe medications, and monitor treatment.
To send prescription orders to affiliated or third-party pharmacies for fulfillment.
To communicate results, care plans, and follow-up instructions.
To comply with HIPAA and applicable medical recordkeeping laws.
Note: PHI is used only for treatment, payment, and healthcare operations as permitted by HIPAA. It is not used for marketing or advertising.
4.3 Communication & Customer Support
To respond to your inquiries, requests, or complaints.
To send appointment confirmations, reminders, and account updates.
To send important safety or legal notices.
With your consent, to send marketing emails, SMS, or other communications about UM products and services.
4.4 Security, Fraud Prevention & Compliance
To monitor, detect, and prevent fraud, abuse, and unauthorized access.
To enforce our Terms of Use and comply with legal obligations.
To respond to subpoenas, regulatory inquiries, or lawful government requests.
4.5 Analytics & Improvement
To analyze usage trends and measure engagement with our Services.
To improve site functionality, user experience, and service offerings.
To develop new features, products, and clinical programs.
4.6 Advertising & Personalization (Non-PHI Only)
To deliver relevant ads and measure campaign effectiveness using non-health data (such as cookie/device data).
To personalize your website experience (e.g., showing content relevant to your state or interests).
Important: PHI and sensitive health data are never used for targeted advertising or shared with ad networks.
5. Your Privacy Rights & Choices
Depending on where you live, you may have certain privacy rights under state law. These rights are in addition to protections you already have under HIPAA for your Protected Health Information (PHI).
5.1 California (CCPA/CPRA)
If you are a California resident, you have the following rights with respect to your personal information (not including PHI, which is governed by HIPAA):
Right to Know: You may request access to the categories and specific pieces of personal information we have collected about you.
Right to Delete: You may request that we delete personal information we collected from you, subject to certain exceptions (e.g., legal obligations, medical records retention).
Right to Correct: You may request correction of inaccurate personal information.
Right to Opt-Out of Sale/Sharing: You may opt out of our âsharingâ of non-PHI personal information with third parties for targeted advertising.
Right to Limit Use of Sensitive Information: You may request that we limit the use of sensitive personal information (other than as required for telehealth or pharmacy services).
Right to Non-Discrimination: We will not discriminate against you for exercising these rights.
5.2 Virginia, Colorado, Connecticut, and Utah
Residents of these states may have similar rights, including the right to access, correct, delete, and opt out of targeted advertising or the sale of personal data.
5.3 Nevada
Nevada law allows residents to opt out of the sale of certain personal information. We do not sell personal information as defined under Nevada law, but you may still submit an opt-out request.
5.4 Washington (My Health My Data Act)

We share only the minimum necessary information to enable care and fulfillment.

If you use lab testing services, we share necessary information with laboratories to process orders and deliver results.

Data is encrypted in transit and at rest using industry-standard protocols.
Secure authentication, firewalls, and intrusion detection tools are used to protect our systems.
Session timeouts and audit logs help monitor access and prevent misuse.

Data centers used by our vendors employ physical security measures, including restricted access and environmental protections.
Paper records (if any) are stored securely and disposed of using appropriate destruction methods.
